VisionBridge Terms of Service (EULA)
Last updated: 2026-10-04 Version: 1.0.0 (draft pending legal review; effective date to be announced)
The Traditional Chinese version is the canonical text and is bundled inside the iOS app (shown at first launch and under Settings → About). This English translation is provided for reference and for Apple App Store submission purposes.
WisBridge Technology Co., Ltd. ("we", "the Company") provides the "VisionBridge" iOS application and its companion cloud services (together, "the Service"). By tapping "I have read and agree to the Terms of Service" or by using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms and the Privacy Policy together form the entire agreement between you and the Company.
1. Nature of the Service: an assistive communication tool, not a medical device
- The Service is an assistive communication tool that helps people who cannot speak but can control eye movement and blinking select preset phrases by gaze, have them spoken aloud, and sync them to a paired caregiver.
- The Service is not a medical device. It does not diagnose, treat, monitor or prevent any disease, does not detect or interpret vital signs, physiological state or consciousness, and does not replace the judgment or care of physicians, nurses, caregivers or any medical professional.
- The "inactivity reminder" (off by default, enabled by the caregiver) fires solely on the fact that the user has not interacted with the app for a set period. It says nothing about the user's physical condition. It is not a medical alarm and not an emergency notification system.
2. Notification delivery: best effort, not guaranteed
- Phrase sync and reminders travel over the internet and Apple's push service. Delivery time and success depend on network quality, device settings (Do Not Disturb, silent mode, notification permissions, Low Power Mode), system state and third-party services. Notifications may be delayed, duplicated or never delivered.
- The Service therefore must not be used as the sole or primary means of safety reporting, calling for help or care supervision, and does not replace a nurse call bell, an attendant or any in-person care arrangement. Caregivers must maintain other available means of care and contact.
- To the maximum extent permitted by law, the Company is not liable for any damage caused by undelivered or delayed notifications.
3. Gaze detection may be wrong
- Gaze and blink detection is estimated in real time by the front camera and software algorithms. Accuracy depends on lighting, posture, distance, eyewear, eye condition, facial occlusion and device model. Mis-selection, missed selection or failed calibration can occur.
- The Company does not warrant that a selected phrase correctly reflects the user's intent. Users and caregivers should confirm important messages (especially pain, discomfort or requests for help) by other means.
4. In an emergency, call 119
If any emergency is suspected (for example breathing difficulty, change in consciousness, a fall or choking), the caregiver or anyone present should immediately call 119 (Taiwan emergency services) or contact a medical professional, and should not rely on the Service.
5. Accounts, pairing and consent by proxy
- Accounts are created anonymously or via Sign in with Apple / email; pairing is completed with a 6-digit code. You are responsible for keeping pairing codes and sign-in details safe and for all activity under your account.
- If the user cannot read or operate these Terms themselves, their legal representative, guardian or a caregiver authorised by the user may read, accept and set up the Service on their behalf ("consent by proxy"). Whoever consents by proxy represents that they have authority to do so and should explain the nature and limits of the Service to the user.
- The Service is not intended for independent use by children under 13; a child's legal representative must consent by proxy and accompany use.
- Either party may end a pairing at any time; phrases stop syncing once a pairing is removed.
6. Licence and intellectual property
- The Company grants you a non-exclusive, non-transferable, revocable licence to install and use the App on Apple devices you own or control, for personal or family-care use, in accordance with these Terms and the Usage Rules in Apple's Media Services Terms. Family Sharing is governed by Apple's rules.
- All copyright, trademark and other intellectual property in the Service, including its software, interface, text, images, voices, phrase library and the marks "眼說" and "VisionBridge", belong to the Company or its licensors. Except as expressly permitted, you may not copy, modify, adapt, distribute, rent, reverse engineer, decompile or otherwise obtain the source code, or remove any proprietary notice.
- Phrases you customise ("User Content") remain yours; you grant the Company a licence to store, transmit and display User Content as needed to provide the Service.
7. Paid plans and subscriptions
- Core features are free. Advanced features may be offered as auto-renewable subscriptions through the Apple App Store, at the price and term shown in the App at the time of purchase.
- Apple charges your Apple account on confirmation of purchase. Subscriptions renew automatically and are charged within 24 hours before the end of the current period unless you cancel in your Apple account settings before then. Cancellation takes effect at the end of the current period.
- Purchases, refunds and billing disputes are handled by Apple under Apple's policies; request refunds through Apple's "Report a Problem". The Company cannot process App Store refunds directly.
- Institutional plans (hospitals, long-term-care facilities, etc.) are governed by a separate written agreement, not by this section.
8. Prohibited conduct
You may not: (1) use the Service for any unlawful purpose; (2) interfere with, damage or attempt unauthorised access to the Service, other accounts or pairings; (3) access the Service by automated means at scale; (4) resell the Service or bundle it into another product (except under an institutional agreement); (5) upload or transmit content that infringes others' rights or is unlawful or harmful.
9. Changes, interruption and termination
- The Company may add, change or discontinue any part of the Service at any time and will try to give in-app notice in advance. To the extent permitted by law, the Company is not liable for suspension caused by maintenance, upgrades, force majeure or third-party outages (including Apple and Google Firebase).
- The Company may suspend or terminate your use if you breach these Terms. You may stop using the Service at any time via "Delete all my data" in the App; deletion follows the Privacy Policy.
- On termination the Company deletes your data within the periods set out in the Privacy Policy.
10. Disclaimer and limitation of liability
- The Service is provided "as is" and "as available". To the maximum extent permitted by law, the Company makes no express or implied warranty of fitness, uninterrupted or error-free operation, security or accuracy.
- To the maximum extent permitted by law, the Company is not liable for indirect, incidental, consequential or punitive damages or lost profits arising from use of or inability to use the Service, and the Company's total liability to you is capped at the fees you actually paid to the Company in the 12 months before the event giving rise to the claim.
- Nothing in this section excludes or limits liability that cannot be excluded or limited under the Consumer Protection Act, the Civil Code or other applicable law (including damage caused by the Company's intent or gross negligence).
11. Third-party services and open-source software
The Service uses Apple (push, speech synthesis, ARKit) and Google Firebase (authentication, database, push, crash reporting), and includes components under open-source licences. The applicable third-party terms and licence notices are available in the App under About → Third-party licences. The Company does not warrant the availability of third-party services.
12. Additional terms required by Apple
- These Terms are between you and the Company only. Apple is not a party and is not responsible for the App or its content.
- The Company, not Apple, is solely responsible for maintenance and support of the App; Apple has no obligation to provide any.
- If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation; any other claims, losses, liabilities, damages or costs attributable to a failure to conform to a warranty are the Company's responsibility.
- The Company, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including product liability, regulatory compliance and consumer-protection claims.
- If a third party claims the App infringes its intellectual property rights, the Company, not Apple, is responsible for investigation, defence, settlement and discharge of the claim.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms; upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
- Developer name and address: WisBridge Technology Co., Ltd., 8F, No. 42, Xuchang St., Zhongzheng Dist., Taipei City 100, Taiwan; support@wisbridge.app.
13. Changes to these Terms and renewed consent
When these Terms change we will update the version number and show an in-app notice. Material changes require you to accept again before continuing. The version you accepted, the time of acceptance and the app version are recorded as evidence of the agreed terms.
14. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of China (Taiwan). The parties agree that the Taiwan Taipei District Court has jurisdiction in the first instance, without prejudice to any mandatory jurisdiction rights granted to consumers by the Consumer Protection Act and the Code of Civil Procedure.
15. Miscellaneous
If any part of these Terms is held invalid, the remainder stays in effect. Failure to enforce a right is not a waiver. The Traditional Chinese version prevails; other languages are for reference only.
